Υπολογιστική νέφους (Cloud Computing ) – Νομικά ζητήματα με έμφαση στην ασφάλεια και στην προστασία προσωπικών δεδομένων

Abstract

Η παρούσα διπλωματική εργασία αποτελεί μια ενδελεχή έρευνα στην Υπολογιστική Νέφους (Cloud Computing) και στα νομικά ζητήματα που προκύπτουν με έμφασηστην ασφάλεια και στην προστασία των προσωπικών δεδομένων. Το Cloud Computing είναι μια καινούρια και πρωτοποριακή τεχνολογία η οποία έχει αρχίσει να αναπτύσσεται και να εδραιώνεται με ταχύτατους ρυθμούς στον τομέα τηςπληροφορικής και των τηλεπικοινωνιών. Εξαιτίας της καινοτομικής συμπεριφοράς που προβάλει η συγκεκριμένη τεχνολογία, οι ορισμοί που περιγράφουν την τεχνολογία του Cloud Computing είναι πολλοί, εμείς θέλοντας να περιγράψουμε μεόσο το δυνατόν απλούστερη ορολογία την έννοια του Cloud Computing, θα λέγαμε ότι είναι η ανάθεση των τεχνολογιών πληροφορικής (Βάση Δεδομένων,Υπολογιστική Πόροι Εξυπηρετητές, Αποθηκευτικοί πόροι, Εφαρμογές, Υπηρεσίες,Δίκτυα κ.α.) μιας εταιρείας ή ενός οργανισμού σε τρίτους, με στόχο την υποστήριξη της εύκολης δικτυακής πρόσβασης. Ειδικότερα δίνεται η δυνατότητα σε μια εταιρεία ή οργανισμό να λαμβάνει όλες τις υπηρεσίες πληροφορικής που χρειάζεται, από κάποιον τρίτο και ανάλογα με τις απαιτήσεις που προκύπτουν να ρυθμίζει το μέγεθοςαυτών των υπηρεσιών. Με την υιοθέτηση λοιπόν του Cloud Computing επιτυγχάνουμε μείωση στο κόστος των υπηρεσιών αλλά και του χρόνου διεκπεραίωσης τους.

The current thesis is a thorough investigation on Cloud Computing and the legal issues that arise, emphasis is given on safety and protection of personal data. Cloud Computing is a new and innovative technology that is being developed and established rapidly in the computers and telecommunications field.Due to the innovative nature of this technology, the definitions that describe Cloud Computing are several. In an effort to describe Cloud Computing in a more simplified way, we would describe it as the assignment of computer technologies (Database,Computational Resources, Servers, Storage Resources, Applications, Services,Networks etc.) of a corporation or an organization to third parties, aiming to the support of easy network access.Specifically, a corporation or an organization is given the possibility to receive the computer services desired from a third party and to control the size of these services according to the requirements. Therefore adopting Cloud Computing leads to cost and time reduction of the services.From the definition given above it becomes obvious that assigning any kind of data to third parties also includes risks. The major risks of Cloud Computing involve security issues of the services but also the security of the data transferred. As a result, the legal frame for the protection of the corporations/organizations from these risks must be defined.
