The present thesis discusses the protection of fundamental rights in the EU, analysing the jurisprudence of the European Court of Justice. More specifically, it focuses on the interplay between the principle of mutual trust and fundamental rights and examines the limits imposed on each concept by the Luxembourg Court. It begins by elaborating on the theoretical framework underpinning the protection of rights in the EU and proceeds by shedding light on the development of the principle of mutual trust. Finally, it delves into an in-depth analysis of the relevant case-law of the Court, examining its approach towards cases where mutual trust comes in conflict with the protection of fundamental rights.
